Public Offer Agreement
Terms of the paid digital subscription to daily child-development email tips from Baby Steps Daily.
This Public Offer Agreement (the “Offer” or “Agreement”) is an official public offer made by the Seller defined below to any natural person of legal capacity (the “Buyer” or “User”) to enter into a contract for the provision of a paid digital subscription service on the terms set out below. Acceptance of this Offer is full and unconditional and is performed in accordance with Article 642 of the Civil Code of Ukraine.
1. Parties to the agreement
Seller: FOP Boiko Alina Volodymyrivna (ФОП Бойко Аліна Володимирівна), an individual entrepreneur registered in Ukraine.

Buyer: any natural person who has reached the age of legal capacity, who has accepted this Offer and who acts as the parent or legal guardian of the child whose data may be used to personalize the service.
2. Subject of the agreement
The Seller undertakes to provide the Buyer with a paid digital subscription service consisting of personalized daily child-development recommendations, tips, activities, and educational materials (the “Service”), and the Buyer undertakes to accept and pay for the Service on the terms of this Offer.
The Service is fully digital. There are no physical goods, no physical delivery, and no shipping.
3. Service description
- The Service is delivered exclusively by email to the email address provided by the Buyer during registration.
- Each daily message is personalized using the parent-provided child profile (such as date of birth, age, and, optionally, sex and focus areas).
- Content is informational and educational only and does not constitute medical, psychological, therapeutic, or other professional advice (see Section 17).
- The Service may include a free trial period followed by a recurring paid subscription, as described in Sections 6–9.
4. Acceptance of the Offer
Acceptance of this Offer (conclusion of the Agreement) takes place when the Buyer performs at least one of the following actions:
- marks the required consent checkbox on the subscription / checkout page;
- confirms the order and is redirected to the payment provider;
- makes the first payment or authorizes a card capture for a trial subscription;
- starts using the Service (receives and uses the first email).
By performing any of the above actions, the Buyer confirms that they have read, understood and unconditionally accept this Agreement, the Payment Policy, the Refund Policy, the Delivery Policy, the Privacy Policy, and the Terms of Service.
5. Subscription pricing and currency
- The price of the subscription is displayed on the subscription/checkout page before payment confirmation.

- Settlement currency: Ukrainian hryvnia (UAH).
- All charges are processed in UAH through the selected payment provider. If the Buyer’s card is denominated in another currency, the issuing bank may apply its own conversion rate and fees, for which the Seller is not responsible.
6. Trial period
- The Service may, at the Seller’s discretion, be offered with a free trial period of {{TRIAL_PERIOD}} (TODO: replace with real trial length, e.g. “3 days”).
- To start a trial, the Buyer authorizes the Seller and the payment provider to verify and store a payment card token. No charge is made to the card during the trial unless explicitly stated otherwise on the checkout page.
- The Buyer may cancel the subscription at any time before the trial period ends to avoid the first paid charge.
- If the Buyer does not cancel the subscription before the end of the trial, the first recurring charge will be performed automatically (Section 7).
7. First payment and recurring billing
- The first payment is charged on the date the trial period ends or, if no trial is offered, immediately upon order confirmation.
- The subscription is automatically renewed at the end of each billing period.

- By accepting this Offer, the Buyer authorizes recurring automatic charges to their saved card for the price of the selected plan, in UAH, for each new billing period, until the Buyer cancels the subscription.
- The Buyer is notified of the renewal date and amount on the checkout page and may receive a reminder email before each recurring charge.
Automatic recurring charges
This subscription includes automatic recurring payments. By confirming payment, the Buyer authorizes recurring charges according to the selected billing period until the Buyer cancels the subscription.
8. Payment providers and card data
- Payments are processed by LiqPay (PrivatBank) and/or WayForPay, depending on the payment provider selected by the Seller in the platform’s settings.
- The Buyer is redirected to a secure payment page of the selected provider to enter card details.
- The website does not store the full card number, the CVV/CVC code, or the full card expiration data. Only a non-sensitive token returned by the payment provider, along with the masked card number, is stored to enable recurring charges and customer support.
- By making a payment, the Buyer also agrees to the rules of the selected payment provider.
9. Failed payments
- If a recurring charge fails (for example, due to insufficient funds, an expired card or a bank decline), the Seller may retry the charge several times within a reasonable period.
- While the payment is pending, access to the Service may be limited or suspended.
- If the payment cannot be collected, the subscription is automatically cancelled and access to the Service is terminated.
10. Cancellation
- The Buyer may cancel the subscription at any time, without giving reasons, by using the cancel/manage-subscription link in any subscription email, or by contacting customer support at {{SUPPORT_EMAIL}}.
- After cancellation, no further recurring charges will be made.
- Access to the paid Service remains available until the end of the current paid billing period, unless the Buyer requests immediate termination.
11. Refunds
Refund rules are described in detail in the Refund Policy. Refunds are issued, where applicable, to the original payment method via the same payment provider that captured the charge.
12. Access termination
The Seller may suspend or terminate the Buyer’s access to the Service in case of:
- repeated failed payments;
- fraud, chargeback abuse, or misuse of payment instruments;
- breach of these terms or of the Terms of Service;
- requests from competent authorities.

The Seller aims to respond to all customer requests within 2–3 business days.
14. Personal data
Processing of personal data of the Buyer and of any child profile data provided by the Buyer (as the child’s parent or legal guardian) is governed by the Privacy Policy. By accepting this Offer, the Buyer confirms that they are the parent or legal guardian of the child and that they provide such data voluntarily and with full authority to do so.
15. Limitation of liability
The Service is provided on an “as is” basis. To the maximum extent permitted by applicable law, the Seller is not liable for any indirect, incidental, consequential, special or exemplary damages arising from the use of, or inability to use, the Service, or from reliance on its content. The total liability of the Seller for any direct damages is limited to the amount actually paid by the Buyer to the Seller during the last paid billing period preceding the event giving rise to the claim.
16. Intellectual property
All content delivered through the Service (texts, illustrations, layout, audio-visual elements, etc.) is the intellectual property of the Seller or used under appropriate licenses. The Buyer is granted a limited, personal, non-transferable, non-commercial right to use the content for the purpose of raising their own child(ren).
17. No medical or professional advice
Educational content only
Content delivered through the Service is for informational and educational purposes only. It is not a substitute for advice from a paediatrician, psychologist, or other qualified professional. The Seller does not guarantee any specific developmental, behavioural, or educational outcomes for the child.
18. Governing law
This Agreement is governed by the laws of Ukraine. Any disputes that cannot be resolved by negotiation between the parties are to be resolved by the competent courts of Ukraine.

20. Final provisions
- The Seller may amend this Offer at any time. The current version is always available at this page. Continued use of the Service after changes constitutes acceptance of the amended Offer.
- If any provision of this Offer is found to be invalid or unenforceable, the remaining provisions remain in full force.
- This Offer is drawn up in English; in case of discrepancies between language versions, the English version shall prevail.
